Replication data for systematic content analysis and logistic regression study conducted in the PhD thesis Courts, science, and climate justice: Examining the role of GHG reduction data in systemic mitigation climate Cases.
The systematic content analysis in this PhD thesis examined how courts in different jurisdictions engage with: (i) empirical questions, (ii) scientific evidence, and (iii) tools for understanding the scientific aspects of disputes, and described case outcomes. The corresponding research questions were:
Do courts engage with relevant empirical questions in their judgments, such as the necessary mitigation measures to keep global warming under control?
Do courts refer to scientific evidence on appropriate mitigation in their judgments, and if so, what types of evidence do they cite?
Do courts engage with qualitative aspects of this evidence, such as its reliability, relevance, or consistency with the parties’ claims?
Do courts use methods to assess the quality, relevance, or meaning of scientific evidence? What tools do they employ in practice? For example, do they seek expert advice or apply judicial tests?
How frequently do different outcomes occur, such as favourable rulings for the petitioners?
The logistic regression study investigated statistically significant associations between: the region of the rulings and references to data about mitigation; the region of the rulings and favourable outcomes for the petitioners; and judicial references to data about mitigation and favourable outcomes for the petitioners, both generally and by region.
