Study 3: When the resident disputes training termination by court

DOI

SummaryThis study examined how Dutch courts handled dismissal disputes between residents, their program directors, and their employers. Case law was collected using keywords like ‘arts in opleiding tot specialist’ and ‘opleiding aios’ via www.rechtspraak.nl and included till 31th of December 2024. The courts interpret the national General Directive on education regulations for residents in training to become medical specialists, and consider the standing of the conciliation board ruling in relation to a decision from the court. Courts may also reflect on reasons for dismissal, due process, and employee protection. Data description (Qualitative data) District Court (Kantonrechter/Rechtbank) Ktr.
